Am I missing something? I mean, I wasn't exactly an A student in civics class, but I do clearly recall that the way the U.S. Constitution was written -- and remains unamended -- is that Congress passes bills and the president either signs them into law or vetoes them. If he signs a bill, it becomes a law that the executive branch is then constitutionally required to enforce.
Am I wrong about that? Did I miss the passage of a constitutional amendment that changed the balance of power established by our founders?
If not, then the president of the United States has broken the law, not just once, but hundreds of times.
That's how many times this guy has signed bills into law and then, after the camera left, signed a separate document he calls "a signing statement," that, in effect, says, "Just kidding. Here's which parts of that bill I just signed that I will enforce, and which parts I won't enforce."
Phillip Cooper is a leading expert on signing statements; in fact he wrote the book on the subject: By Order of the President: The Use and Abuse of Executive Direct Action. Two years ago Cooper wrote that George W. Bush had issued 23 signing statements in 2001; 34 in 2002, raising 168 constitutional objections; 27 statements in 2003, raising 142 constitutional challenges; and 23 statements in 2004, raising 175 constitutional criticisms. In total, during his first term Bush raised a remarkable 505 constitutional challenges to various provisions of legislation that became law.
That number has now passed 750.
The White House claims all this is constitutionally kosher. But how can it be? Would someone explain to me how these noxious signing statements are any different from the line-item veto, which the U.S. Supreme Court ruled was unconstitutional? If you read one of Bush's signing statements they read very much like a line-item veto -- "Yes to this part of the bill, no to this part," etc. Sure looks like a duck to me.

The Bush administration has done more damage to Americans and more harm to America's reputation than any other administration in history. Yet, a majority of Republicans still support Bush. This tells much about blind party loyalty.
By encouraging the move offshore of American jobs and manufacturing, Bush has run up tremendous trade deficits that have undermined the world's confidence in the dollar as the reserve currency. Recently, both Chinese and Russian government officials warned of the dollar's shaky status. The fall in confidence in the dollar is evidenced by the sharp run-up in the price of gold. In January 2001 the price of gold was about $240 per ounce. Today the price is $660 per ounce.
The price of gasoline has risen from around $1.30 per gallon to over $3.00 per gallon. Obviously, Bush's war in the Middle East did not ensure the oil supply.
On Bush's watch, three million US manufacturing jobs have disappeared. Tens of thousands of highly qualified US engineers have lost their employment. US job growth has fallen six to seven million jobs behind population growth. Recent college graduates are employed as waitresses and bartenders.
Illegal immigration has continued to explode. While Bush spends $1 trillion and many lives trying to control borders in the MIddle East, America's borders remain undefended and over run. Bush advocates amnesty for the illegals who have invaded America while Bush invades distant countries.
On false pretenses Bush invaded Iraq, a country that comprised no threat to America. American high explosives have devastated Iraq and its infrastructure and killed at least 100,000 Iraqi civilians, people who Bush claims to be bringing freedom and democracy.
All stability has disappeared from Iraq. Iraqis now live in fear of one another as well as fear of American troops. On April 28 Iraqi vice president Adil Abdul-Mahdi said that 100,000 Iraqi families have been uprooted by the sectarian violence unleashed by Bush's overthrow of Saddam Hussein.
Not content with the uncontrollable mayhem he has brought to Iraq, Bush hopes to expand the catastrophe by attacking Iran. The US Secretary of State, sounding like the warmonger she is, says the US may ignore the United Nations and attack Iran on its own initiative. This would be the second time that the Bush administration initiated wars of aggression--war crimes under the Nuremburg standard established by the US.
Bush claims that he is higher authority than both US law and international law. In the past, US presidents vetoed laws with which they disagreed. Bush signs the laws and ignores them.
Bush has declared himself to be the sole judge of the limits of his powers--a claim that violates Bush's oath of office to uphold the US Constitution. Bush has set aside the Bill of Rights by detaining people indefinitely without charges, by kidnapping and torturing people, and by spying on Americans without warrants. These are actions that are illegal under law as well as unconstitutional. All of these violations of law and the Constitution are serious impeachable offenses.
Yet. Congress is supine as the Bush regime exercises dictatorial powers. The exercise of these dictatorial powers by the executive is a far greater danger to American liberty than are Muslim terrorists.
Bush's apologists claim that only terrorists have anything to fear. However, unaccountable executive power is inconsistent with free societies. America is no exception. Unless Bush is impeached and turned over to the war crimes court in the Hague, Americans will never reclaim their liberties from an executive branch that has established itself as the sole judge of the limits of its powers.
As Jacob Hornberger, president of the Future of Freedom Foundation wrote last month, "we now live in a nation in which the president has the omnipotent power to ignore all constitutional restraints on his power." Bruce Fein, a Justice Department official in the Reagan administration said that Bush "is moving us toward an unlimited executive power."
The Bush regime's practice of excessive secrecy and denial of information to Congress allows the regime to avoid judicial review of its power claims. Bush ignores Congress and evades the courts.
When President Richard Nixon made excessive claims for presidential powers, principled Republicans revolted and helped to bring down Nixon. Today's Republicans are loyal only to power. They have no principles. By supporting Bush, Republicans are bringing down America.

Did you know that under the terms of the new Patriot Act prosecutors will be able to seek the death penalty in cases where "defendants gave financial support to umbrella organizations without realizing that some of its adherents might eventually commit violence"? (NY Times; editorial 10-30-05) So, if someone unknowingly gave money to a charity that was connected to a terrorist group, he could be executed.
 
Or, that the Senate Intelligence Committee is fine-tuning the details of a bill that will allow the FBI to secretly procure any of your personal records without "probable cause" or a court order giving them "unchecked authority to pry into personal and business matters"? (New York Times, "Republicans seek to widen FBI Powers, 10-19-05)
 
Or, that on June 29, President Bush put "a broad swath of the FBI"
under his direct control by creating the National Security Service (aka; the "New SS")? This is the first time we've had a "secret police" in our 200 year history. It will be run exclusively by the president and beyond the range of congressional oversight.
 
Or, that on October 27, 2005 president Bush created the National Clandestine Service, which will be headed by CIA Director Porter Goss and will "expand reporting of information and intelligence value from state, local and tribal law enforcement entities and private sector stakeholders"? This executive order gives the CIA the power to carry out covert operations, spying, propaganda, and "dirty tricks" within the United States and on the American public. ("The New National Intelligence Strategy of the US" by Larry Chin, Global Research)
 
Or, that Pentagon intelligence operatives are now permitted to collect information from US citizens without revealing their status as government spies? ("Bill would give Cover to Pentagon Spies", Greg Miller, Times Staff writer, "The Nation")
 
Or, that within 2 years every American license and passport will be made according to federal uniform standards including microchips (with biometric information) that will allow the government to trace every movement of its citizens?
 
Or, that recent rulings, the DC District Court unanimously decided in two different cases that foreign prisoners have no rights under international law to challenge their indefinite imprisonment by the United States and, (in Rumsfeld vs. Padilla) that the president can lock up an American citizen "without charges" if he believes he may be an "enemy combatant"? Both verdicts overturn the fundamental principles of "inalienable rights", habeas corpus, and the presumption of innocence; replacing them with the arbitrary authority of the executive.
 
The American people have no idea of the amount of energy that has been devoted to stripping them of their constitutional protections and how stealthily that plan has been carried out. It has required the concerted efforts of the political establishment, the corporate elite, and the collaborative media. For all practical purposes, the government is no longer constrained in its conduct towards its citizens; it can do as it pleases.
 
The campaign to dismantle the Bill of Rights has focused primarily on the key amendments; the 1st, 4th, 5th, 6th, 8th and 14th. These are the cornerstones of American liberty and they encompass everything from due process to equal protection to free speech to a ban on the "cruel and unusual" treatment of prisoners. Freedom has little tangible meaning apart from the safety provided by these amendments.
 
At present, there's no reason for the administration to assert its new powers. That would only dispel the widely-held illusion of personal freedom. But, the existing climate of "well being" will not last forever. The poisonous effects of war, tax cuts, burgeoning budget deficits, and inflation indicate that darker days lie ahead. The middle class is stretched paper-thin and disaster could be as close as a hike in interest rates. The new repressive legislation anticipates the massive political unrest that naturally follows a tenuous and volatile economic situation.
 
Is this why Congress has rubber stamped so many of the administration's autocratic laws, or does Bush simply "hate our freedoms"?
 
The members of America's ruling elite carefully follow the shifting of policy in Washington. They have the power to access the mainstream media and dispute the changes in the law that they oppose. Regrettably, there's been no sign of protest from the bastions of the corporate, financial and political oligarchy; just an ominous silence.
 
Does this mean that American Brahmins have abandoned their support for personal liberty and the rights of man?
 
America is undergoing its greatest metamorphosis. It has been severed from its constitutional moorings and is drifting towards a police state. If Samuel Alito is appointed to the Supreme Court then Bush will be able to solidify his "unchecked" power as executive and 50 years of progressive legislation will be up for review. Everything from abortion to Miranda will be reconsidered through the hard-right lens of the new majority.
 
Americans still seem blissfully unaware of the fundamental changes to the political system. The cloak of disinformation and diversion has successfully obscured the perils of our present course. Freedom is no longer guaranteed in Bush's America nor is liberty everyman's birthright. The rickety scaffolding that supports the rule of law has been replaced by the unbridled authority of the supreme presidency. The country is slipping inexorably towards the Orwellian nightmare; the National Security State.

EXECUTIVE ORDER 10990 allows the government to take over all modes of transportation and control of highways and seaports.
 
EXECUTIVE ORDER 10995 allows the government to seize and control the communication media.
 
EXECUTIVE ORDER 10997 allows the government to take over all electrical power, gas, petroleum, fuels and minerals.
 
EXECUTIVE ORDER 10998 allows the government to seize all means of transportation, including personal cars, trucks or vehicles of any kind and total control over all highways, seaports, and waterways.
 
EXECUTIVE ORDER 10999 allows the government to take over all food resources and farms.
 
EXECUTIVE ORDER 11000 allows the government to mobilize civilians into work brigades under government supervision.
 
EXECUTIVE ORDER 11001 allows the government to take over all health, education and welfare functions.

EXECUTIVE ORDER 11051 specifies the responsibility of the Office of Emergency Planning and gives authorization to put all Executive Orders into effect in times of increased international tensions and economic or financial crisis.
 
EXECUTIVE ORDER 11310 grants authority to the Department of Justice to enforce the plans set out in Executive Orders, to institute industrial support, to establish judicial and legislative liaison, to control all aliens, to operate penal and correctional institutions, and to advise and assist the President.
 
EXECUTIVE ORDER 11049 assigns emergency preparedness function to federal departments and agencies, consolidating 21 operative Executive Orders issued over a fifteen year period.
 
EXECUTIVE ORDER 11921 allows the Federal Emergency Preparedness Agency to develop plans to establish control over the mechanisms of production and distribution, of energy sources, wages, salaries, credit and the flow of money in U.S. financial institution in any undefined national emergency. It also provides that when a state of emergency is declared by the President, Congress cannot review the action for six months. The Federal Emergency Management Agency has broad powers in every aspect of the nation. General Frank Salzedo, chief of FEMA's Civil Security Division stated in a 1983 conference that he saw FEMA's role as a "new frontier in the protection of individual and governmental leaders from assassination, and of civil and military installations from sabotage and/or attack, as well as prevention of dissident groups from gaining access to U.S. opinion, or a global audience in times of crisis." FEMA's powers were consolidated by President Carter to incorporate the...
 
National Security Act of 1947 allows for the strategic relocation of industries, services, government and other essential economic activities, and to rationalize the requirements for manpower, resources and production facilities.
 
1950 Defense Production Act gives the President sweeping powers over all aspects of the economy.
 
Act of August 29, 1916 authorizes the Secretary of the Army, in time of war, to take possession of any transportation system for transporting troops, material, or any other purpose related to the emergency.
 
International Emergency Economic Powers Actenables the President to seize the property of a foreign country or national. These powers were transferred to FEMA in a sweeping consolidation in 1979.
